In that spirit, these Terms of Use will govern your use of this website, including any information or materials contained on or accessed through this website (all of which we refer to simply as the “website”). You should read these terms carefully before using the website. If you do not agree with any of these terms, then you should not use this website. #1 – I’m Not Your Doctor!
Although I am a medical doctor, I am NOT YOUR doctor. All of the materials and information on this website are for general education, and nothing on this website is intended to, nor does it in fact, constitute medical advice, medical opinion, medical diagnosis or medical treatment. This is true even the individuals posting on this website, or whose postings are accessible through this website, refer to their medical or other professional credentials or background.
Your mere use of this website also does not create and a coach-client relationship or contract, or any other professional and contractual relationship. If you pay for a membership, the terms of that membership will create a separate contract. If you hire us or one of our coaches to provide you with coaching, you will be asked to sign or agree to a separate contract.
#2 – You Consent to Communications
When you sign up for our email list, you consent to receiving emails from us. You can unsubscribe at any time.
#3 – You are Responsible for Your Account
From time to time, certain services offered on or through the website may be available only to users who have registered with us and been granted an account with a username and password. If you register for any such account, all registration information you submit in relation to your account must be truthful and accurate, and you must maintain the accuracy of that information. You are responsible for activity that occurs in connection with your account. Accordingly, you should your account login information confidential. If you suspect unauthorized use of your account, you agree to immediately notify us. If at any time you wish to delete account, you should follow the instructions on the website.
#4 – We (Might Be) Watching
It won’t surprise you to learn that, as a general matter, we do not actively monitor the use of this website under normal circumstances. We nevertheless reserve the right to monitor the use of this website at any time, to remove any materials that may be illegal, may subject us to liability, may violate these terms, or are inconsistent with the purpose of this website. In any such case, we are entitled to use our discretion in making determinations about what use is illegal, may subject us to liability, may violate these terms, etc.
#5 – Don’t Do Bad Stuff
Okay, the lawyers make us say this stuff. When you use this website, you agree not to use the website in any of the following obviously inappropriate ways:

- to post or transmit anything under a false identity, for the purpose of misleading others, or that is unlawful, libelous, defamatory, obscene, fraudulent, predatory, harassing, threatening or abusive
- to link our website to/from a site that is unlawful, abusive, indecent or obscene, that promotes violence or illegal acts, that contains expressions of racism, that is libelous, defamatory, scandalous, or inflammatory or is other inappropriate. In this regard, we get to decide what is appropriate, inappropriate, etc.
- to post or transmit anything that infringes upon the intellectual-property rights of others or the privacy or proprietary rights of others
- to attempt to disrupt the operation of our business in any way, including through viruses, Trojan horses, worms, time bombs, denial-of-service attacks, flooding, spamming
- to solicit business or promote or advertise the business on behalf of anyone else
- to attempt to gain unauthorized access to any user’s account
to harvest or otherwise collect information about others, including names, addresses, or e-mail addresses
- to modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the website, or assist anyone else in doing so.
Any unauthorized use by you will terminate your right to use our website.
#6 – It Is What It Is
Life is full of possibilities, not guarantees. This website is the same. In other words, we believe that we use reasonable efforts in collecting, preparing and providing quality information and material, but the people behind the Mama Doc website are human after all. Therefore, we cannot guarantee the accuracy, completeness, or adequacy of the content on this website. The lawyers tell us that this means the website is provided to you on an “as is” and “as available” basis. We do not provide any express warranties or representations, and to the fullest extent permitted under applicable law we disclaim all implied warranties and representations, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Furthermore, while we try to keep the website operational and functioning as best we can, we cannot promise you that the website will always be available on an uninterrupted 24/7/365 basis. We cannot promise you that the website will at all times be secure, error free, or free of viruses or other harmful code (there are bad folks out there!).
#7 – Limits on Liability; Indemnity
We are not liable to you or any third party for any damages arising from or relating to your use or inability to use the website, or relating to these Terms of Use. For the record, “no damages” means “NO DAMAGES,” including this intimidating laundry list of damages: direct, indirect, incidental, special, consequential, exemplary, incidental, special, or punitive damages, personal injury, wrongful death, lost profits. Moreover, when we say we are not liable, we mean it, and this will remain true even if we know of or you advise us of the possibility of any damages you may suffer. If you live in a state with laws that limits our ability to contract out of certain kinds of damages, then this Section 6 will apply to the fullest extent permitted by law.
Notwithstanding the above, our sole liability for any reason to you, and your exclusive remedy for any claim whatsoever, will be limited to the amount paid by you for any product or service purchased by you from us through the website; provided, however, that any claim in connection with your use of the website must be brought within one year after the event giving rise to such action occurred.
By using the website, you agree to fully indemnify and hold us harmless from any damages we incur, including our associated costs, expenses and legal fees (including costs of investigation), as a result of any direct or third-party claim brought against us and involving: (a) your use of or reliance on the information on the website; (b) your violation of these Terms of Use or any applicable laws or regulations; or (c) any content you upload to the website. We nonetheless reserve the right to assume the exclusive defense and control of any matter for which you are required to indemnify us, and in such case you will cooperate with our defense.

So for example, the narrative on this website is a copyrighted work protected by copyright law. You are welcome to download information from this website, and you may print out a hard copy, for your personal use provided that you keep our work intact and do not remove or alter any copyright or other notice (e.g., trademark, patent, etc.) contained in the information. You are not welcome to, and you may not, modify, copy, distribute, display, reproduce, sell, license, or create derivative works from any information or website content, in whole or in part, including any text, images, audio, and video in any manner, without our prior written permission. In addition to complying with all applicable laws, you agree that you will not use our trademarks, service marks, trade dress, or other logos from this website without our prior written permission.
